With their dismissal letters formally erased, at least 746 Junior Secondary School (JSS) teachers who were fired by the Teachers Service Commission (TSC) in June have been put back on the payroll.

This decision is the result of an extensive investigation by the Ministry of Education, which found that due procedure was not followed in the dismissals.

The Kenya Union of Post Primary Education Teachers (KUPPET) Secretary General, Akelo Misori, expressed happiness with the resolution.

He made it clear that none of the teachers in question had received a chance to defend themselves in a disciplinary session.

“We are happy to inform our members and the public at large that all Junior Secondary School (JSS) teachers who were fired in June 2024 have been reinstated. According to Misori, all of the impacted teachers have had their dismissal letters revoked and have been put back on the payroll.

Misori criticized the initial firings, claiming that they went against natural justice principles that demand that people be given a chance to be heard before facing consequences.

KUPPETS strongly objected to the dismissals because they violated the natural justice norms, which provide that no one should be convicted without a trial. “At a disciplinary hearing, none of the impacted teachers had been given the chance to defend themselves,” he continued.

The TSC’s announcement in June that 742 JSS teachers would be fired sparked the debate.

This move was a part of a larger reaction to the widespread demonstrations spearheaded by intern teachers, who began to demonstrate in the streets on May 13 in an effort to seek improved working conditions and permanent employment.

Frustrations over short-term contracts and insufficient assistance drove the widespread rallies.

TSC claims that the termination and replacement of some instructors’ contracts resulted from their non-reporting for duty and their whereabouts being unknown.

According to TSC, “there are 742 teachers whose contracts were terminated and replaced, whose whereabouts are unknown, and who did not report back.”

TSC recruited new instructors across the nation to replace the fired teachers in reaction to the unrest.

In an effort to get an explanation for their absence, the commission sent show-cause letters to those who had resigned from their positions on May 22.

Even with the reinstatement, there are still issues that KUPPET and the affected teachers need to work out, including getting their contracts converted to permanent posts with pensions.

The government’s erratic adherence to these employment criteria has deeply alarmed the union.

The predicted 20,000-position shortfall in JSS teaching posts, which persists, makes resolving these issues even more urgent.

Sadly, the primary problem of converting the instructors into permanent, pensionable work remains unaddressed despite their reinstatement. The government’s waning commitment to the teachers’ permanent contracts and hiring of 20,000 additional instructors to fill the massive JSS gap deeply worries KUPPET, he stated.

Misori stated that if the problems are not rectified, the union’s National Governing Council intends to meet shortly to discuss possible industrial action. The objective of the proposed action is to preserve the benefits provided to KUPPET members under the 2021–2025 Collective Bargaining Agreement (CBA) Addendum, including pay increases and other employment benefits, and to protect the teachers’ employment rights.

“In due time, the union’s National Governing Council will convene to approve industrial action to protect the benefits of present KUPPET members under the 2021–2025 CBA Addendum, including pay increases and effective labor practices,” he said.
